Restaurant and entertainment venue inspired by Bob Marley and his family (Ziggy, Cedella, Stephen, Damian, Julian, Rita).

This is a fully licensed and approved venue by the Marley family.

This is the second contest we have held for this Logo. The prior in December 2011 gave us some good logos, however we are seeking a more refined design, and less tshirt/touristy design.

Discussion

 
The project is a 700 seat full service restaurant, with the capacity to handle up to 2,500 people. It is over 20,000 square feet in size, and will also have a very large retail store.

One thing we for sure do not want is something that looks like the thousands of existing Bob Marley merch designs.

While design #1 may not be exactly what we want, it does exhibit some originality.

We would also be interested in seeing "Orange Beach, Alabama" incorporated into a few of the designs.

Issues is correct. Unless the contest holder has provided images that they own the full copyright to, designers should not be tracing images of Bob Marley off the internet as it could possibly lead to serious legal issues for the contest holder as well as you being removed from the contest.

Anyone submitting to this contest is doing so at his or her own risk until the client can verify with Support that the client has unlimited rights to use BOTH the name and the imagery associated with Bob Marley.

We are not aware that all images of Bob Marley are exclusive property of the Marley family.

This logo design, the use of both Bob's image and the name "Bob Marley Cafe" for the purpose of this logo design is fully approved and supported by the estate and family of Bob Marley.

Dear reelsolution,

Unfortunately even if the family fully supports the use of Bob Marley's image it does not protect them from copyright infringement if a designer traces an image that belongs to someone else such a photographer or other entity.

If you have images that are fully owned by the family (that is the photographer has transferred the full copyright to the family or estate or they took the photo themselves) then they should be posted for the designers to use.

There are no rights from the photographer overcoming the rights of the Official Bob Marley entity.

And it is precisely the other way around the Photographer must have authorization from model to publish the images.

The photo you used is owned by, and copyrighted to British photographer Adrian Boot. Use without permission of Urban Image is prohibited.

The other photo (from santg9design) belongs to photographer Kate Simon.

Unless the Marley family has permission to use AND license to permit others to use the photos, this constitutes copyright infringement.

For the record I am both a Designer and a Professional Photographer
(Alumni of the New York Institute of Photography.)

Legally speaking:

- The PHOTOGRAPHER who took the shot (Not the Marley family) owns the copyright of the image according to the law.
- Nobody INCLUDING the Marley family can use the image without the photographers FULL release of the copyright. That is also the law.
- No designer/entity/family can trace the photographers copyrighted image without release of copyright from the photographer who took the shot.

Thx for all opinions on this.

Obviously, it is not my intention to infringe any law. Never did, and sure will not on a legendary historical image. Thats absurd!!
I just did my part, and I'm sure it will be possible to verify if the design can be used or not…

JMHdezine , you are right, there are Papparazzi Pictures and Authorized pictures. Adrian Boot was the "official" photographer.
Papparazi images are not authorized, and sometimes tabloids ARE SUE.

tabloids - I believe - are protected as journalists. The value of the photograph is not the photo or the person in the photo, so much as the photo is used as part of the story as a graphic element.

Alexandre, this is not about releases or anything having to do with permission to take or publish a photograph. It's about infringing on the copyright of the person who took the photo you used in your design. So unless a full release was given to the estate, you do not have the right to trace the photo and are violating the copyright.

JMHdesine, Client already has history on LT for a Bob Marley "official"contest… if he can easily use the Name it wouldn't be expectable that he can also use the iconic image ? I mean isn't Bob Marley a true Brand ?

I'm not sure what you don't understand about this Alexandre? You DO NOT have the legal right to trace a photograph that belongs to someone without their permission! The copyright belongs to Adrian Boot. If you do not know that you have his permission to trace one of his photos and use it for commercial purposes then you can not legally use it. You can either do an original drawing or trace a photo taken by the family, etc.

Image Licensing
Image content in the UrbanImage archive must be licensed before use. Content can be licensed for specific predefined usages, meaning that you must identify how, where and to what extent an image is required to be used.

Usage fees are based on the requested usage. You are typically granted one-time usage rights and must follow UrbanImage's conditions for usage, which are set out below, and are finalized as part of your invoice. You understand that you are not purchasing the image itself, just a license to use an image and you are not allowed to edit or alter images unless authorized.

You must ensure the identification of copyright owner and agency, in such a way that prevents any doubt about such information pertaining to a certain image. Omission of such image and copyright information will incur a surcharge of 100% of the agreed publication fee. UrbanImage will inform you of image and copyright information and it will be stated in your invoice.

When licensing an image from UrbanImage, you understand that there is limited usage of the image. You can also request exclusive rights to a particular image and eliminate simultaneous usage by competitors for a limited time.

Images may be stored locally for a limited time and you must limit access to those persons who are directly involved in creation of the licensed use as set out as part of your invoice. You must also not make images publicly accessible. Following your licensed use, you must cease to use all images and delete/destroy any copies. Images remain the property of UrbanImage and its images suppliers.

Any license granted by UrbanImage is on the condition that you obtain all necessary third-party rights. You agree to provide UrbanImage with proof of all such rights upon request. Images may not be used as a trademark, for unlawful purpose, to defame any person, to infringe on privacy, to break any copyright or trade name of any person or entity.

Unless otherwise specified in writing, your use of images is limited to the specific usage as set out in your invoice. However this license is only granted on your meeting all conditions imposed in this agreement and your invoice, and on UrbanImage receiving all payment within 30 days of you receiving your invoice. Failure to meet these criteria will void any license granted to you and will constitute a violation of copyright law.

The license granted to you is non-transferable: work produced incorporating the image must be for your own use or for the use of your direct employer, client or customer, who must be the end user of your work. Re-selling or re-licensing is not permitted.

On request of UrbanImage, you are obliged to provide free of charge, a copy or access to the work produced by you incorporating the image for our records.

I would suggest that designers draw their own version of Bob Marley's likeness (but not from a particular photo to avoid any copyright infringement ).

Our intent is to honor Bob Marley's memory and to make His Family, and the tens of millions of Bob Marley fans throughout the World proud of the venue we are about to create. The logo(s) that we are able to secure through this killer medium that is Logo Tournament will be seen by hundreds of thousands of people annually.

Hopefully within 4 or 5 months from now, we'll begin plugging Bob Marley's Orange Beach on there, and eventually have a dedicated site. Hi All,

The client misunderstood what she was allowed to ask of you.

She will arrange images for use from the family.

Until we receive confirmation in some written for of image releases we will be placing a hold on the payment to the contest. I am sure we will come to a reasonable solution.

We are directly linked to 56 Hope Road.

We have a catalog of images owned by 56 Hope Road, and approved for use in the venue logo. There are several thousand owned images available to us.

Our staff will review the images we might want included in the logo, and we will hold another contest in the very near future. We will post those images for contestants.
